Consent for Use of Electronic Records and Signatures



Please carefully read this Consent for Use of Electronic Records and Signatures and print or download a copy for your records. It contains important information about how Wilmington Trust (“we,” “us,” and “our”) will deliver the Online Access Disclosure Agreement (“Disclosure Agreement”) to you in connection with your account(s). The words “you” and “your” mean the person giving consent.

Electronic Records and Signature Disclosure

You are entitled to receive the Disclosure Agreement in writing. However, with your consent, we may provide the Disclosure Agreement to you electronically instead. If you are willing to receive and sign the Disclosure Agreement electronically and you have the hardware and software needed to access the Disclosure Agreement, please provide your consent as described herein.

Your Consent to Use Electronic Signatures and Records

If you can access the Disclosure Agreement electronically to your satisfaction through the Wilmington Trust website and agree to this Consent for Use of Electronic Records and Signatures, please indicateAgreement electronically through the Wilmington Trust website.

Your consent applies solely to the Disclosure Agreement. Your consent means that we will allow you to view and sign the Disclosure Getting Paper Copies

At any time, you may request from us a paper copy of the Disclosure Agreement by contacting your Relationship Manager. We will not charge you a separate fee for sending you a paper copy of the Disclosure Agreement. In addition, you may download and print the Disclosure Agreement through the Terms of Use page on our website.

Maintaining a Valid Email Address

You agree to provide us with, and maintain, a valid e-mail address and/or other contact information needed to contact you electronically. You agree to promptly notify us of any changes to your email address and other contact information by contacting your Relationship Manager.

Withdrawing and Consequences of Withdrawing Your Consent to Electronic Agreement

You may change your mind at any time and withdraw your consent to receive the Disclosure Agreement electronically by contacting your Relationship Manager. You may also simply decline to sign the Disclosure Agreement from within your electronic signing session on our website. There is no fee when you withdraw your consent. If you withdraw your consent, you may not be able to access or use online service provided through OnLine Portfolio or OnLine Statements.

Contacting Us and Your Relationship Manager:

You may contact your Relationship Manager if you wish to request a paper copy of the Disclosure Agreement or want to withdraw your consent to receive the Agreement electronically. Please refer to your account statements for contact information for your Relationship Manager.

Required System Hardware and Software:

The minimum system requirements for accessing the Disclosure Agreement may change over time. The current system requirements are:

  • A personal computer (or other electronic device) and equipment that is capable of: (a) accessing the Internet to review and retain the Disclosure Agreement; and (b) printing copies of information from our website (if you want paper copies) or storing data (if you want to retain electronic copies); and
  • A supported operating system and Internet web browser that are capable of supporting, at a minimum, JavaScript and 128-bit SSL encrypted communications.


If the system requirements change, and that change creates a material risk that you will not be able to access or retain the Disclosure Agreement, we will provide notice of the revised system requirements to you.

Data Retention Policy:

The Disclosure Agreement will be stored and available to you through the Terms of Use page on the Wilmington Trust website. You agree to print or download the Disclosure Agreement should you wish to retain it for your own records, as described in the ‘Getting Paper Copies’ section of this Consent for Use of Electronic Records and Signatures. If you have any trouble printing or downloading the Disclosure Agreement, you may contact your Relationship Manager.

Acceptance and Consent:

By selecting the check-box next to “I have reviewed and accept the above disclosure”, you agree to the terms and conditions in this Consent for Use of Electronic Signatures and Records and you confirm that:

  • You have read and understand this Consent for Use of Electronic Signatures and Records;
  • You have the minimum hardware and software described above to access the Disclosure Agreement and agree to promptly provide us with any change or update to your email address and contact information;
  • You can print on paper or electronically save this Consent for Use of Electronic Records and Signatures for your future reference and access, or you can email this Consent for Use of Electronic Records and Signatures to an email address where you will be able to print it on paper or save it for your future reference and access; and
  • You consent and agree to receiving the Disclosure Agreement electronically as described herein and to the use of electronic records and signatures with respect to the Disclosure Agreement.
